With Immigrant Construction Workers and Families – Let’s Fight Against Structural Discrimination

 

According to government statistics, 855 workers died last year while working, 428 of which died at construction sites. More than half of deadly industrial accidents are related to construction. Most of the dead were immigrant workers.

It was last September. Won, Ok-Geum, a co-representative of an association for Vietnamese Workers in South Korea, brought a case to GongGam. Here is the story. Nguyen(alias) is a construction worker who came from Vietnam. Since entering South Korea in 2011, he has worked at construction sites. In July, 2019, he worked on a project to build tunnels on the Banpocheon basin in Seoul. On September 25th, 2019, in an accident, Nguyen’s head got caught between stone-carrying trucks at an excavating site. He died at the scene. After hearing the news, his wife came to South Korea with two children to see what had happened and to hold a funeral for him. Sadly, the second child was just born two months before Nguyen died.

As you know, people working at construction sites are temporary-contracted and the employment is very unstable. So, getting severance pay is almost impossible. Working for more than a year at the same company guarantees the minimum benefit, but construction workers find it difficult to work that long for the same company. Ironically, they are the ones who truly need such benefits. Severance pay plays an important role in helping family members if the bread winner is unable to work or dies suddenly. The Act on the Employment Improvement, Etc. of Construction Workers provides that construction workers may receive mutual-aid money for retirement even though they work intermittently by moving from one site to another. In accordance with this Act, the construction company needs to subscribe for retirement mutual-aid and pay the mutual-aid installments per day corresponding to the labor which a construction worker(beneficiary) provides to the Construction Workers Mutual-Aid Association (CWMA). When a construction worker retires, the Construction Workers Mutual-Aid Association pays the mutual-aid money to the worker with interest. If a construction worker dies at a construction site due to industrial accidents, the bereaved family member will receive the money.

In accordance with this law, Nguyen’s wife applied for mutual-aid money to the association. However, it refused to pay her the money, saying “She is not eligible because she is a foreigner and is not residing in South Korea.” The CWMA referred to the provision “The scope of a bereaved family receiving the mutual-aid for retirement shall be governed by Article 63 of Industrial Accident Compensation Insurance Act” and said the Article 63 of Industrial Accident Compensation Insurance Act stipulates that a bereaved family member who is not a South Korean and resides outside South Korea cannot receive retirement allowances in place of the dead person. In other words, the CWMA claims that the South Korean law excludes foreigners from receiving such benefits and thus its refusal is legal and reasonable.

Considering a large number of immigrant construction workers who are working in South Korea alone, this is absolutely discrimination against immigrant workers themselves and their families. A similar public-interest case was brought to GongGam a few years ago, though we could not take the case to the court as sufficient documents to file a lawsuit were not ready. Anyway, Nguyen’s case clearly shows how construction workers and their family members have been badly-treated and discriminated by law. Fortunately, some legal revisions have been made and bereaved family members, regardless of nationality, can get mutual aid money for retirement. However, the revised law will be put in force from May 27th ,2020 and is not retroactive, which means Nguyen’s wife and his two children are still excluded. The same goes for construction workers who were in accidents or died before the enforcement date. There is a possibility that the CWMA continues to refuse the payment going forward by interpreting the law in its favor.   

Therefore, GongGam(Park, Young-Ah and Yoon,Ji-Young, attorneys for the plaintiff) ,on behalf of Nguyen’s family, files a complaint against the CWMA for mutual-aid for retirement and applies for a judicial review of the constitutionality of statutes. We will do our utmost to get the best result.

건설이주노동자와 그 가족에 대한 제도적 차별에 맞서 소송을 시작하다

 

정부 통계상, 작년에 산업재해 사고로 숨진 노동자는 855명입니다. 이 중 428명은 건설 현장에서 사망했습니다. 절반이 넘는 산재 사망 사고가 건설 현장에서 발생했습니다. 그리고 건설 현장에서 사망하는 노동자 중 상당수가 이주노동자입니다.

작년 9월입니다. 베트남공동체의 대표인 원옥금 씨가 공감에 소송을 의뢰했습니다. 사연은 이렇습니다. 응웬(가명) 씨는 베트남에서 온 건설노동자입니다. 2011년 한국에 들어온 후로 계속 건설 현장에서 일을 하던 그는 2019년 7월부터는 서울 반포천 유역 터널 공사 현장에서 일을 했습니다. 그러던 2019. 9. 25. 응웬 씨는 지하 암반 굴착 현장에서 돌을 나르는 차들 사이에 머리가 끼어 즉사했습니다. 이 소식을 듣고 베트남에 거주하던 그의 아내가 장례를 치루고 수습을 하기 위해 한국에 왔습니다. 응웬 씨에게는 두 명의 자녀도 있습니다. 둘째 아이는 그가 사망하기 두 달 전에 태어났습니다.

건설노동자들은 일용직으로 일을 하기 때문에 고용이 불안정합니다. 그래서 건설노동자는 퇴직금을 받기가 하늘에 별따기입니다. 퇴직금은 1년 이상 계속 근무를 해야 인정되는데 건설노동자는 그렇게 일하기 힘들기 때문입니다. 그러나 건설노동자야말로 퇴직금이 필요한 사람들입니다. 일이 끊겨 돈을 벌 수 없을 때, 갑작스런 사고로 다치거나 죽어 생계가 막막할 때 퇴직금은 긴요한 역할을 합니다. 그래서 「건설근로자의 고용개선 등에 관한 법률」은 건설노동자가 일용직으로 건설공사장을 옮겨 다니더라도, 간헐적으로 일을 하더라도 퇴직금 성격의 퇴직공제금을 받도록 하고 있습니다. 이 법에 따라, 건설사업주는 퇴직공제에 가입해서 건설노동자(피공제자)의 노동에 상응하는 공제부금을 일(日) 단위로 건설근로자공제회에 납부해야 합니다. 그리고 건설노동자가 건설업에서 퇴직한 경우 건설근로자공제회는 누적된 공제부금에 이자를 더해서 해당 건설노동자에게 퇴직공제금으로 지급해야 합니다. 만약 건설노동자가 현장에서 사고 등으로 사망한 때에는, 그 유족이 사망한 노동자를 대신하여 퇴직공제금을 받게 됩니다.

이런 절차에 따라 응웬 씨의 아내는 건설근로자공제회에 퇴직공제금을 요청했습니다. 그러나 건설근로자공제회는 “건설노동자가 사망할 당시 유족이 외국인이고 국내에 거주하지 않았다면 퇴직공제금을 받을 자격이 없다”며 지급을 거부했습니다. 그 근거로 법규정을 들었습니다. 「건설근로자의 고용개선 등에 관한 법률」은 “퇴직공제금을 지급받을 유족의 범위에 제63조는 ‘근로자가 사망할 당시 대한민국 국민이 아닌 자로서 외국에 거주하고 있던 유족은 유족보상연금을 받을 수 없다‘고 명시하고 있기 때문이라는 것입니다. 즉 법률에서 대한민국에 거주하지 않는 외국인 유족은 제외하였기 때문에, 퇴직공제금을 지급할 수 없다는 것입니다.

그러나 절대 다수의 건설이주노동자가 본국에 가족을 남겨 두고 홀로 한국에 와서 일을 하고 있는 상황에서, 이는 외국인노동자와 그 가족에 대한 부당한 차별일 수밖에 없습니다. 몇 년 전에도 공감에는 같은 내용의 공익 소송 신청이 들어온 적이 있습니다. 필요한 서류가 준비되지 않아 소송을 하지는 못했지만 말입니다. 어쨌든 이러한 상황은 이주노동자와 그 가족이 제도적으로 차별과 피해를 당하고 있다는 것을 보여 줍니다. 물론 최근 법률이 개정되어서, 본국에 거주하는 외국인 유족도 퇴직공제금을 받을 수 있는 길이 열렸습니다. 그러나 개정 법률은 2020. 5. 27.부터 시행되고 소급 적용되지 않기 때문에 응웬 씨의 유족은 여전히 퇴직공제금을 받을 수 없습니다. 마찬가지로 2020. 5. 27.전에 사고를 당한 노동자의 유족도 퇴직공제금을 받을 수 없습니다. 건설근로자공제회가 개정 법률을 자의적으로 해석해서 앞으로도 지급을 거부할 가능성도 있습니다.

이에 공감(대리인 박영아 변호사, 윤지영 변호사)은 응웬 씨의 유족을 대리하여 건설근로자공제회를 상대로 퇴직공제금 청구의 소를 제기합니다. 동시에 법률 규정에 대하여 위헌법률심판제청을 신청하였습니다. 좋은 결과를 낼 수 있도록 최선을 다하겠습니다.
